  14. SHAREWARE END-USER LICENSE AGREEMENT

  16. This End-User License Agreement ("EULA") is for the PassMark
  17. BurnInTest software.
  18.  
  19. This PassMark End-User License Agreement ("EULA") is a legal agreement
  20. between you (either an individual or a single entity) and PassMark
  21. Corporation for the PassMark software product identified above,
  22. which includes computer software and may include associated media,
  23. printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT").
  24. By installing, copying, or otherwise using the SOFTWARE PRODUCT,
  25. you agree to be bound by the terms of this EULA.
  26. If you do not agree to the terms of this EULA, do not install or use
  27. the SOFTWARE PRODUCT;

  29. 1. GRANT OF LICENSE. This EULA grants you the following rights:
  30. ╖ A license is granted only after the payment of the license fee.
  31. ╖ If no license fee has been pay the product can be used for
  32.   evaluation purposes for a maximum period of 30 days.
  33. ╖ After the license fee has been paid, you may install and use one copy
  34.   of the SOFTWARE PRODUCT, on a single computer, or on a single removable
  35.   disk for each license purchased. The SOFTWARE PRODUCT must NOT be
  36.   installed on a network where it could be potentially accessed by
  37.   more computers than licenses purchased..
  38. ╖ The primary user of the computer on which the licensed SOFTWARE PRODUCT
  39.   is installed may make a second copy for his or her exclusive use
  40.   on a portable computer.
  41. ╖ When a site license is purchased, the purchasing organization may
  42.   make unlimited use of the SOFTWARE PRODUCT within that organization.
  43.   An organization is a single legal entity and does not include
  44.   affiliates, partners, subsidiaries or franchises of the organization.

  46. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

  48. ╖ Limitations on Reverse Engineering, Decompilation, and Disassembly.
  49.   You may not reverse engineer, decompile, or disassemble the SOFTWARE
  50.   PRODUCT.
  51. ╖ The shareware version of the software may be freely distributed
  52.   provided that no fee is charged and the product is distributed
  53.   complete and intact.

  55. 3. COPYRIGHT.

  57.  All title and copyrights in and to the SOFTWARE PRODUCT
  58.  (including but not limited to any images, photographs, animations, video,
  59.  audio, music, text, and "applets" incorporated into the SOFTWARE PRODUCT),
  60.  the accompanying printed materials, and any copies of the SOFTWARE PRODUCT
  61.  are owned by PassMark or its suppliers. The SOFTWARE PRODUCT is protected
  62.  by copyright laws and international treaty provisions. Therefore, you
  63.  must treat the SOFTWARE PRODUCT like any other copyrighted material
  64.  except that you may install the licenced SOFTWARE PRODUCT on a single
  65.  computer provided you keep the original solely for backup or archival  purposes.

  67. LIMITED WARRANTY. PassMark warrants that (a) the licenced 
  68.  SOFTWARE PRODUCT will perform substantially in accordance
  69.  with the accompanying written materials for a period of
  70.  ninety (90) days from the date of receipt, and (b) any
  71.  Support Services provided by PassMark shall be substantially
  72.  as described in applicable written materials provided to
  73.  you by PassMark, and PassMark support engineers will
  74.  make commercially reasonable efforts to solve any problem
  75.  issues. Some states and jurisdictions do not allow
  76.  limitations on duration of an implied warranty, so
  77.  the above limitation may not apply to you. To the
  78.  extent allowed by applicable law, implied warranties
  79.  on the SOFTWARE PRODUCT, if any, are limited to ninety
  80.  (90) days.

  82.  no warranty is offered.
